JobFlare Privacy Statement
JobFlare owns and operates the website located at www.JobFlare.com (across desktop, mobile, tablet and apps and including any subdomains) (the “Site”). This Statement discloses our information gathering and dissemination practices for the Site.
JobFlare is committed to maintaining your privacy.
JobFlare is committed to providing you with the best possible customer service experience.
JobFlare is bound by the Privacy Act 1988 (Cth.) (the “Privacy Act”), which contains the Australian Privacy Principles (the “APPs”) concerning the privacy of individuals.
This Privacy Statement applies to any personal information you disclose to JobFlare through your use of any products on the Site, including but not limited to, becoming a Registered User and creating a JobFlare profile.
Definitions
Where used in this Statement, the terms “personal information”, and “Australian Privacy Principle(s)” or “APPs”have the meaning attributed to that term in the Privacy Act.
This Statement has been prepared by JobFlare Australia Pty Ltd (ABN 74 605 501 380) “JobFlare”, “we”, “us” and “our”.
“Registered Recruiters” or “Recruiters” are recruiters who have been confirmed to be legitimate recruiters working for agencies seeking people for legitimate jobs.
Visitors of the Site who do not create an account are referred to generically in this Statement as “visitors”
Users who register on the Site to obtain services offered by JobFlare are referred to as “Registered Users”. Unless the context provides otherwise, references in this Statement to “visitors” include references to Registered Users.
Collecting anonymous information on JobFlare visitors
JobFlare collects non-personal information on visitors including, without limitation, which sections of the site are frequently visited and the duration of the visit. This data is always non-personal information, and may be shared with JobFlare partners to provide them with information relating to how JobFlare visitors 'use' the Site. This information is collected to ensure the best possible customer service is provided to visitors of the site.
IP Addresses
JobFlare’s web servers gather your IP address to assist with support issues and to monitor the use of our site.
Cookies & Applets
JobFlare uses cookies and applets to provide you with a better browsing experience. These cookies and applets collect non-personal information such as preferences and click activity for measurement and for features such as remembering your details for 'Auto Login' (provided you have selected this option).
Users who do not wish to have cookies active whilst they browse the site can modify their privacy options in their browser. However, doing so may prevent access to some areas of the Site and limit your use of some of the JobFlare services.
Measurement
For each visitor to reach the site, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering a better service to you while you are at this Site.
Collecting personal information on JobFlare Registered Users
As part of registering with JobFlare, we collect personal information about Registered Users in order for Registered Users to take full advantage of JobFlare's services. We collect this personal information directly from you through our forms, website and discussions with you. We do not collect your personal information from third parties.
Registration
Becoming a Registered User allows you to take advantage of the tools, services and resources that may assist you in advertising yourself in the best possible manner to “Registered Recruiters”. To become a Registered User you will need to submit some personal information such as your name and email address and be asked to enter a password. You may access your information at any time by clicking 'My Profile' on the site.
JobFlare Profile
The information that you choose to make available on a JobFlare profile includes your contact details, full employment and educational history, salary expectations, skills projects & achievements that you possess and preferred job role and locations of employment.
“Registered Recruiters” are able to search JobFlare's candidate database to find and contact relevant candidates.
Your full name (only your first initial and last name are visible to “recruiters”), contact details and salary expectations are NOT automatically visible to recruiters.
Your full name, and contact details only become available to “recruiters” once you have accepted a contact request.
From time to time your Profile status may change. These statuses are detailed below:
Standard
Your JobFlare Profile, except for your Full name, contact details and salary expectations, can be seen by Recruiters searching the JobFlare database.
If a Recruiter wishes to contact you regarding an opportunity, that recruiter may send you a contact request where you will have the option to “accept” or “decline” the request. On acceptance your full name, and contact details will be provided to the Recruiter.
Inactive
Other databases are rarely used by Recruiters because the Profiles on them are often out of date by months, or even years. JobFlare requires Registered Users to “refresh” their profile weekly by indicating that “Yes” they are still looking for a new opportunity. This system ensures that Recruiters are only contacting people who are open to a new opportunity and ensures its use by Recruiters.
Failing to indicate that “Yes” you are still looking for a new opportunity will make your status “Inactive” until you confirm that you are still looking for a new opportunity.
Having a status of “Inactive” means your profile does not appear in any searches conducted by Recruiters.
Subscription Payments will be discontinued where you have a status of “Inactive”
Withdrawn
A “Withdrawn” status means that you have chosen for your profile to be completely suspended until you choose to reactivate it.
This status can occur if:
You have selected “No”, you are no longer looking for a new opportunity to the weekly “refresh” contact.
Your profile has been “Inactive” for a period longer than 1 month
There has been a report of abuse of the JobFlare Terms against you while this report is being investigated
A status of “Withdrawn” means that your profile will not be included in any searches and any Subscription Payments will be discontinued.
Your profile will still be available to you if you choose to return and activate it at any time without having to recreate it from scratch. This is handy in cases where you have successfully gained employment and are no longer open to new opportunities, then after a period of time circumstances change and you are now open to advertising yourself to Recruiters for suitable opportunities.
Terminated or Cancelled
A “Terminated” status means that JobFlare has cancelled your account due to you infringing the Terms of the website.
A “Cancelled” status means that you have permanently cancelled your JobFlare account in your Account Settings area.
A Cancelled or Terminated status means that your profile will not be included in any searches and any Subscription Payments will be discontinued. JobFlare reserves the right to disable or delete a profile at its discretion, especially in instances where poor conduct has been reported.
We may still retain your personal information in our systems for legal compliance and quality control, but it will no longer be publicly available to your, or on the JobFlare Site.
Recruiter Contact
As indicated, prior to a contact request Recruiters only have access to limited information.
This information consists of:
your last name and first initial, for example - Smith.J;
your preferred job location;
your preferred job role and title;
your preferred availability such as days and times;
whether you have a car licence or not; and
your employment summary, which includes full employment and educational history as well as what skills projects & achievements that you possess.
A Recruiter is able to use the JobFlare system to conduct highly detailed and refined searches to look for Registered Users who match their criteria.
On reviewing the profile a Recruiter may send a “contact request” to the Registered User requesting an “interview” time and providing some general information on the role and themselves.
On accepting the contact request you authorise JobFlare to pass on your full name and contact details to the Recruiter who is requesting contact with you.
Declining notifies the Recruiter that you have declined the request.
Any questions you have relating to a position should be directed directly to the Recruiter, not JobFlare. JobFlare is NOT an employment site and does NOT advertise any job vacancies or have any input or control in any jobs a recruiter may contact you for. JobFlare is a site designed to help Registered Users advertise themselves better to opportunities.
Recruiters that are active on JobFlare are asked by JobFlare to comply with all relevant obligations relating to the use and disclosure of personal information that are contained in the Privacy Act. The use of your information (personal or otherwise) by these Recruiters is not within the control of JobFlare and we cannot accept responsibility for the conduct of these companies.
You have the right to directly contact Recruiters to request access to any personal information that has been provided to them as part of a JobFlare Profile.
Communications from JobFlare
In addition to the weekly “refresh” contact, JobFlare may also provide you with information about job seeking, job placement and career-related topics in email communications. “Registered Users” may also be provided with information relating to job seeker comparisons, as well as search and recruiter activity on the JobFlare site.
JobFlare may also make Registered Users aware of additional products and services relating to JobFlare.
Registered Users understand that the weekly “refresh” contact is a binding agreement with JobFlare as it is essential to the site’s operation.
Registered Users may however 'opt-out' of receiving promotional emails from JobFlare in the “Account Settings” area of the site, otherwise users may opt out by clicking 'unsubscribe' in the footer of an email received.
Contractors and Third Parties
JobFlare may also disclose your personal information to JobFlare's service providers and contractors from time to time but only for the purpose of assisting us to deliver the products and services we offer to you.
Our website may contain links to other websites. We are not responsible for the privacy practices of linked websites and linked websites are not subject to our privacy policies and procedures.
Storage & Security of Personal Information
JobFlare takes all reasonable steps to ensure the security of its system and to protect your information from misuse, interference and loss as well as unauthorized access, modification or disclosure. JobFlare allows you to access your information at any time to keep it accurate and up to date. Any information which we hold for you is stored on secure servers that are protected in controlled facilities.
In addition, our employees and the contractors who provide services related to our information systems are obliged to respect the confidentiality and privacy of any personal information held by JobFlare. Except in the case of breaches of our obligations under the Privacy Act to protect your personal information, JobFlare will not be held responsible for events arising from unauthorized access of your personal information.
Please ensure that at all times you maintain the confidentiality of any password and accounts used on the Site and notify us immediately if there is any unauthorised use of your account by any other Internet user, or any other breach of security of which you become aware.
Access to Your Information
Unless you become a Registered User, JobFlare does not collect information that identifies you personally. If you become a Registered User, you are able to change, update, archive or clear your Profile at any time by logging into the “My Profile” section of the site.
You may access the personal information we hold about you, upon making a written request. We will respond to your request within a reasonable period. We may charge you a reasonable fee for processing your request (but not for making the request for access).
We may decline a request for access to personal information in circumstances prescribed by the Privacy Act, and if we do, we will give you a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons).
If, upon receiving access to your personal information or at any other time, you believe the personal information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.
If we refuse to correct your personal information, we will give you a written notice that sets out our reasons for our refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint.
As stated above, you also have the right to request your personal information directly from Recruiters who you have accepted contact requests from.
Data Transfers and Disclosures
Sometimes, we transfer or disclose information to 3rd party contractors including to persons and businesses outside Australia including in New Zealand, United States of America, UK, Ireland and India. These transfers (which may include transfers of personal information) are made in order to assist us to provide you with the products and services we offer you. Where we transfer information to persons outside Australia we take reasonable steps to ensure that the recipients of such information do not breach the Australian Privacy Principles in relation to that information.
Generally, we only use or disclose personal information about you for the purposes for which it was collected (as set out above). We may disclose personal information about you to:
(a) service providers, who assist us in operating our business, and these service providers may not be required to comply with our privacy policy;
(b) our related entities and other organisations with whom we have affiliations so that those organisations may provide you with information about goods and services and various promotions.
Feedback and Complaints about privacy and the JobFlare website
JobFlare welcomes feedback and stores feedback that users send to us. This feedback may be used to administer and refine the service we provide and may be shared with JobFlare partners with specific identifying characteristics removed.
If you have any complaints about our dealings with your personal information including any breaches by us of any Australian Privacy Principles or any questions regarding this Privacy Statement you are able to submit that complaint or query by contacting us at privacy@JobFlare.com or using the methods detailed in the “Contact Us” section of the site.
Any complaints received by us will receive prompt investigation and a written response will be provided to you as soon as possible.
Should you not be satisfied with the resolution of any complaints made you are able to JobFlare further redress through the Office of the Australian Information Commissioner (see http://www.oaic.gov.au/privacy/privacy-complaints for further information).
Privacy & Site Changes
From time to time, JobFlare may review and update its Privacy Statement. Revised versions will be updated on the Site.
